1. Acceptance of Terms
By purchasing access to and/or using the Reimagine Tours self-guided tour application (“App”), you (“User”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not purchase or use the App. Use of the App constitutes acceptance of these Terms and the Stripe payment policies applicable to your transaction.
2. Access and Usage
- Access Codes: Upon purchase, you will receive a unique access code to use the App.
- Limited Access Period: Access codes are valid for 12 hours from the time they are first used to log into the App. After the 12-hour period expires, the code will become inactive, and access will terminate automatically.
- Single Use Only: Each access code is single-use and may not be shared, transferred, resold, or reused. If you need access after expiration or loss of access, you must make a new purchase.
3. Tour Types and Content
- Concise Tours: Approximately 2 minutes of audio per location.
- Extended Tours: Approximately 15 minutes of audio per stop.
- Main Attraction Tours: May include up to 1 hour or more of audio with detailed information about selected attractions.
- Content duration is approximate and may vary. Reimagine Tours does not guarantee exact timing, uninterrupted service, or specific coverage of any attraction.
4. No Refund Policy
- Strict No Refunds: All purchases are final and non-refundable, regardless of reason, including but not limited to:
- Misuse or user error (e.g., failure to enter the code correctly, device issues, accidental deletion, network issues, website issues, login issues, or failure to use the App within the access period).
- Dissatisfaction with content length or detail.
- Failure to use the App before access expires.
- By purchasing, you acknowledge and agree that you waive the right to any refund, reversal, or chargeback under Stripe’s dispute resolution policies.
5. Payment Disputes and Chargebacks
- Any dispute or chargeback initiated through Stripe or your payment provider will be vigorously contested. Records of your purchase, access code delivery, and usage logs will be provided as evidence of fulfilled service.
- Users initiating a chargeback without valid cause may be permanently banned from future Reimagine Tours services.
6. Intellectual Property
- All content, including but not limited to audio files, text, maps, branding, and software, is the exclusive property of Reimagine Tours or its affiliates.
- You may not record, copy, distribute, or publicly perform any content obtained through the App without prior written consent.
7. Liability Disclaimer
- Reimagine Tours, its employees, contractors, and affiliates are not legally bound for any direct, indirect, incidental, or consequential damages resulting from:
- Use or inability to use the App.
- Device failure, loss of internet connectivity, or GPS inaccuracies.
- Accidents, injuries, or delays occurring during tours or while following directions provided in the App.
- The App is provided “as is” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or uninterrupted operation.
8. User Responsibility
- Users are solely responsible for ensuring their device compatibility, battery life, and internet connection before and during use.
- Use of the App while driving or engaging in other potentially dangerous activities is strictly prohibited.
9. Modifications to Terms
Reimagine Tours reserves the right to modify these Terms at any time without notice. Updated Terms will be posted within the App or on our website. Continued use after updates constitutes acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by and construed under the laws of the country/city you use the app for, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the courts of the city/region and you consent to their jurisdiction.
11. Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.
12. Entire Agreement
These Terms constitute the entire agreement between you and Reimagine Tours and supersede any prior or contemporaneous agreements, representations, or understandings.
